The Employer Coverage Unit (ECU) is responsible for WV employer compliance with state workers’ compensation law. All WV employers are statutorily required to maintain workers’ compensation insurance coverage. Compliance related activities include reviewing employer applications for exemption from workers’ compensation insurance and issuing an opinion on the exemption.
The Employer Coverage Unit also works with other State Agencies to verify coverage and revoke licenses when necessary. The ECU works with the National Council on Compensation Insurance (NCCI to maintain the Proof of Coverage system (POC). The ECU uses the POC system to verify coverage for other state agencies, governmental bodies and the general public. Other compliance duties include assessing fines and license revocations for noncompliant employers, receiving and determining coverage status for Uninsured Employer Fund (UEF) claims, establishing new UEF fine accounts and UEF claim accounts, and the reconciliation of Workers’ Compensation Old Fund accounts.
