The Consumer Services Unit of the Property and Casualty Division can help consumers with questions and concerns for their automobile, homeowners, motorcycle, boat, pet, commercial property, commercial general liability and workers compensation insurance.   You may call to discuss your policy with one of our Property and Casualty Specialist.  To give us permission to investigate the issue with the insurance company, please complete our online complaint form or we can mail you a form to complete.  Please see the "Complaint Process" to learn more about our assistance.

How to File an Insurance Complaint

What we can do for you:

  • Protect you by enforcing West Virginia laws
  • Help you with insurance complaints involving:
    • - Sales and policyholder services
    • - Premium rates/refunds
    • - Cancellations/non-renewals
    • - Claim delays/denials

What we can NOT do for you:

  • Give legal advice, act as your lawyer or interfere with a pending lawsuit.
  • Can not recommend an insurance company or agent
  • Can not decide disputes based on who is negligent or at fault

How to Complete the Complaint Form

  • You may file a complaint online or by using the paper form
  • Complete the form with as much informationas  you have available and attach additional information as necessary
  • Tell us what happened including who, what, when and where
  • The Complaint Form must be signed and dated, providing authorization for us to proceed.

What to send with your Complaint Form (copies only, you should keep the originals)

  • Correspondence you have written or received
  • Your policy or excerpt of benefits with policy number and insurance company name

The Complaint Process

  • You will receive an acknowledgement letter indicating the file number and name of your complaint specialist
  • A copy of your complaint will be forward to the appropriate parties
  • The West Virginia Offices of the Insurance Commissioner will respond with the results
  • An inquiry usually takes about 60 days, depending on the complexity of the case
  • If you receive any additional information regarding your complaint, please let us know

West Virginia Automobile Insurance Plan (AIPSO)

The West Virginia Automobile Insurance Plan (WVAIP) was created in order to provide insurance coverage for those people who can not obtain insurance through the voluntary market. In this capacity, the WVAIP ensures that these applicants are shared equitably among all insurers licensed to write auto insurance in the state of West Virginia.

Consumers possessing a valid West Virginia driver's license and a vehicle registered in West Virginia are eligible to be assigned through the WVAIP. For further information consumers should consult their agent or broker.

West Virginia Fair Plan for Homeowners and Property Insurance

The West Virginia FAIR Plan began operating in 1986, to make basic property insurance available to persons who have an insurable interest in real or tangible personal property located in West Virginia, and who have been unable to secure such insurance from the voluntary insurance market.

COVERAGES PROVIDED 

On Habitational property and on Commercial property the Plan will issue a simplified language policy affording coverage against direct loss to real or tangible personal property at a fixed location in the State of West Virginia caused by limited perils.  Please see the Plan's website for further information.
