The “Insurance Commissioner of West Virginia” is an agency created by the legislature. The agency consists of an Insurance Commissioner and employees necessary to carry out the responsibilities of the agency. The Insurance Commissioner is appointed by the Governor. The commissioner shall be a citizen and resident of this state.
The commissioner is authorized to promulgate and adopt rules relating to insurance as are necessary to discharge his or her duties and exercise his or her powers and to effectuate the provisions of this chapter, protect and safeguard the interests of policyholders and public of this state.
