Question: Can a claimant request an emergency hearing because of financial reasons? If so, how long would this take?
Answer: You can request an expedited hearing. Normally we schedule them about 45-60 days out, but we can go for as little as 10 days. That will depend upon the cooperation of the opposing attorney, however. You should mail us a request for an expedited hearing and state your reason. You should send a copy to either your employer or the employer's lawyer if they have one. Be sure to include your claim number and social security number. The hearing is only part of our process. A final decision on your protest will NOT be made at the hearing. We have set a time deadline for filing of evidence. We cannot decide the case until after that deadline has passed. We also have a process by which you can request that the Time Frame be ended, but, again, that will depend upon you getting agreement of your employer.
