How long does it take for the Office of Judges to make a decision on a disability claim? Are they obligated by law and state code to make a decision within a certain time frame? |

There is currently no time limit, to rule on a protest, that is imposed on the Office of Judges by either case law or statute. We have self-imposed time standards that we try our very best to meet. The time standard varies in length depending upon the complexity of the issue involved. For disability cases, the length of the time standard depends upon the nature of the protest. For Permanent Partial Disability (PPD) protests, our time standard is fifteen (15) months. That is from date of acknowledgement of protest to date of decision. The time standard for Permanent Total Disability protests is eighteen (18) months. We also have a self-imposed goal that we try to issue a decision in any type of protest within 90 days of our Order Submitting Protest. |
