What happens after a protest is filed? |
| Answer: |
Upon receiving a timely protest, the Office of Judges issues an Acknowledgment and Automatic Time Frame Order. This document sets forth the time allotted for each party to present any evidence they wish to offer for consideration in the final decision. It is during this allotted time (called a time frame) that hearings are held, testimony given, and other evidence submitted into the claim record. During this time, the parties may also make written motions (e.g. for extension of the time frame in order to obtain additional evidence; for a continuance of a scheduled hearing, etc.). At the expiration of the time frame, an Order Submitting Protest is issued, and the protest is assigned to an adjudicator for final decision. |
