The submission deadline for ALL QHP plans (form, rate and templates) is April 15, 2015. These plans include:
1) QHP SERFF binder filings and associated SERFF filings for On or both On and Off Exchange

FILING GUIDANCE FOR INDIVIDUAL AND SMALL EMPLOYER HEALTH
Plan Year 2016 guidance for filers of individual and small group health plans, for both ON and OFF the Federally Facilitated Marketplace.
Pursuant to the implementation of the Patient Protection and Affordable Care Act (PPACA), the federal government mandated rules for the rating and review of health insurance. As in previous years, the West Virginia Offices of the Insurance Commissioner will engage in “marketplace plan management”.
The following dates and corresponding actions relate to plan year 2016.

||First day SERFF Plan Management will accept filings.
|April 15, 2015
Last day carriers are allowed to submit to Department. Whether ON-Marketplace or both ON and OFF-Marketplace, all carriers must submit their Plan binder(s), templates and rates in SERFF. Off Marketplace only do not need to complete binders. Carriers, On and Off, must have HIOS and Carrier ID numbers.
When all initial rates are submitted to the WV OIC, federal rules are currently dictating to the states that we must submit all rates to them for posting, whether or not the filings are on or off the federally facilitated marketplace or whether or not the rates meet the “unreasonable” threshold as defined under federal law. However, carriers should note that rates may be and are subject to change until FINAL review and approval by the WV OIC.*

Public Information Kiosk
Located in room 301 of the West Virginia Offices of the Insurance Commissioner, 1124 Smith Street, Charleston, WV. All public rate & form filings are available for viewing through the kiosk. The kiosk allows access to filings stored in the agency's imaging system as well filings stored with the National Association of Insurance Commissioners System for Electronic Rate & Form Filing (SERFF). Due to the limited availability of access via this single terminal, reservations are recommended and may be made up to 30 days in advance by calling (304)-558-2094.
No fee is associated with the use of the kiosk. However, copies of filings viewed at the kiosk may be requested and obtained for the appropriate fee.
