How do I file an appeal? |

Write a letter or submit a Notice of Appeal form, attach a copy of the Office Judges order that is being appealed, and mail to the Workers’ Compensation Board of Review at P. O. Box 2628, Charleston, WV 25329-2628. |

Appeal numbers are assigned after the appeal arrives at the Board of Review. |

What is the difference between a protest and an appeal? |
| |
Protests are filed to Commission/Administrator orders, and can be protested to allow for additional evidence to be presented before the Office of Judges. The Administrative Law Judge issues a final order, which can then be appealed to the Board of Review. |

Do I have to hire an attorney? |
| |
Claimants or unincorporated employers do not have to be represented before this Board; however, incorporated employers must be represented. |

I just got a new doctor’s report, can I send it to the Board to prove my injury is worse? |

No. This is a reviewing Board and cannot entertain new evidence. |

Do I have to come to the hearing? |
| |
No. Oral argument is optional, since the Board is a reviewing body and does not receive new evidence. |

What can I do if I don’t agree with the Board of Review’s decision? |
| |
Any party has the right to appeal to the Supreme Court of Appeals within 30 days from the date the Board of Review’s decision. |

I can’t come to Charleston for my hearing, will you reschedule the hearing closer to my home? |
