How do I file an appeal?
  Write a letter or submit a Notice of Appeal form, attach a copy of the Office Judges order that is being appealed, and mail to the Workers’ Compensation Board of Review at P. O. Box 2628, Charleston, WV 25329-2628.
I’m filling out my appeal form and I don’t know the appeal number.
  Appeal numbers are assigned after the appeal arrives at the Board of Review.
What is the difference between a protest and an appeal?
  Protests are filed to Commission/Administrator orders, and can be protested to allow for additional evidence to be presented before the Office of Judges. The Administrative Law Judge issues a final order, which can then be appealed to the Board of Review.
Do I have to hire an attorney?
  Claimants or unincorporated employers do not have to be represented before this Board; however, incorporated employers must be represented.
I just got a new doctor’s report, can I send it to the Board to prove my injury is worse?
  No. This is a reviewing Board and cannot entertain new evidence.
Do I have to come to the hearing?
  No. Oral argument is optional, since the Board is a reviewing body and does not receive new evidence.
What can I do if I don’t agree with the Board of Review’s decision?
  Any party has the right to appeal to the Supreme Court of Appeals within 30 days from the date the Board of Review’s decision.
I can’t come to Charleston for my hearing, will you reschedule the hearing closer to my home?
  All hearings are scheduled in Charleston.
